An employer in Canada may require to obtain a Labour Market Impact Assessment (LMIA) before recruiting a foreign worker. If the LMIA is positive, it means that a foreign worker is needed to fill the position. It will also show that there are no Canadians available for the job. A positive LMIA is referred to as a confirmation letter.
Before recruiting foreign labour, most firms must obtain government approval, which is now known as a Labour Market Impact Assessment (LMIA), also known as a Labour Market Opinion (LMO).
A worker can then apply for a work permit after receiving the LMIA. Workers who need LMIAs must apply for Temporary Foreign Worker Programs (TFWPs).
The labour market impact assessment (lmia) process has recently undergone some changes in 2021! Thus, as part of the new LMIA system, job positions come under two categories: high-paying and low-paying. High-wage jobs are those where the salary is above the median wage in the province where the job is done, while low-wage jobs are those where the salary is below the median.
However, the application fees for LMIA requests have been increased from $275 per worker to $1000 per worker.
LMIAs are issued by the federal department of Employment and Social Development Canada (ESDC). Nevertheless, the application process varies depending on the type of program you’re applying for. Four groups for Labour Market Impact Assessment (LMIA):
After receiving the LMIA, your foreign employee can apply to Immigration, Refugees and Citizenship Canada for a work permit (IRCC).
After receiving an LMIA request, the human resources department typically takes about two months to process it. With advertising and LMIA, the entire process takes about three months. Upon approval of their LMIA, foreign workers can apply for work permits.
When the skilled foreign worker arrives in Canada, a Canada Border Services Agency (CBSA) officer will issue the Canadian Temporary Work Permit. An entry visa depends on the foreign worker’s citizenship.
At the border, public health measures are constantly changing based on the COVID-19 situation. You can find information on the most up-to-date regulations on the Canadian government website.
In addition to a visitor visa, your new employee may also need an electronic travel authorization, depending on their country of origin. The document comes with the work permit. If their application is approved, they may also have to take a medical exam, depending on what type of work they will do in Canada and where they have lived last year.
